Utilities - 220 ILCS

​220 ILCS 5/8-509 & 5/8-510
These sections establish the legal authority for a public utility to enter upon, take or damage private property in the manner provided by the law of eminent domain for the construction of any alterations, additions, extensions or improvements ordered or authorized under the act. For the purpose of making land surveys a utility may enter upon property of any owner who has refused permission after 30 days written notice. The utility is responsible for any damages.

220 ILCS 50/2.3
This section defines activities that constitute excavation for purposes of the Federal Surface Mining Control and Reclamation Act of 1977 and under State Law.

220 ILCS 55/2 Through 55/4
These sections establish the legal authority for a company to enter upon any lands to make surveys and construct and maintain telegraph lines. Compensation shall be paid to the private property owner as provided for under the law of eminent domain. No company shall have the right to erect structures on public property except with the written consent of the county board or corporate authorities which consent shall be recorded in the county recorders office.
